These Terms of Service ("Terms") form a binding agreement between you and Tasskel LLC, doing business as Tasskel Capital ("Tasskel Capital," "we," "us"). They cover your use of our website, funding request forms, member portal, and our Affiliate and Funding Partner programs (together, the "Services"). If you do not agree, please do not use the Services.
By using the Services you confirm you have read these Terms and our Privacy Policy, and you agree to do business with us electronically, including by email, electronic signature and electronic records. A request for business funding may also be subject to separate terms from the funding provider, which you will receive before any agreement is made.
1. Changes. We may update these Terms from time to time. Updates take effect when posted on this page, and the date above shows the latest version. Continuing to use the Services means you accept the updated Terms.
2. Eligibility. You must be at least 18 and able to enter a binding contract. The Services are offered in the United States only and may not be available in every state. Tasskel Capital does not discriminate on any basis prohibited by law, and we expect every funding provider we work with to follow the same standard.
3. Your account. You are responsible for activity under your account, for keeping your login secure, and for keeping your information accurate. Tell us right away about any unauthorized use. Do not use another person's account.
4. Acceptable use. You agree not to: scrape or copy the Services; use bots or automated tools without permission; send spam or unsolicited messages; upload viruses or harmful code; try to break or bypass our security; overload our systems; collect other users' personal information; impersonate anyone or hide your identity; commit fraud; or use the Services for anything unlawful.
5. Our role. Tasskel Capital is not a lender and does not make credit decisions. We connect businesses with third-party funding providers, who make all approval, amount, rate and term decisions. No approval, amount, rate, term or timing is guaranteed.
6. Communications. By giving us your email or phone number, you agree we may contact you about your request, account and the Services, including required notices by email or text. Marketing messages are sent only with your consent, and you can opt out at any time by replying STOP to texts, using the unsubscribe link in emails, or contacting us.
7. Affiliate and Funding Partner programs. Joining a program requires an approved application. We may approve, reject, suspend or end any account at our discretion. Compensation is set only by the compensation plan assigned to your account and its version in effect at the time. Commissions accrue only after the triggering event in that plan, and may be reversed for fraud, duplicates, chargebacks, or rule violations.
8. Referrals and attribution. Referrals are credited using referral codes and first-party cookies for the attribution window set by the program. Our records decide credit. You may not refer yourself, submit information without the person's consent, promise approval, rates or amounts, or use misleading, spam, or unlawful marketing. You must disclose your relationship with Tasskel Capital when you promote us.
9. Payouts and taxes. Payouts are made in batches after approval, currently by PayPal or another method we offer. You must provide accurate payout and tax information (such as a W-9). You are responsible for your own taxes. Program members are independent and are not employees or agents of Tasskel LLC.
10. License and content. We grant you a limited, revocable, non-transferable right to use the Services and any marketing materials we provide, only as permitted here. Tasskel Capital's name, logo and content belong to us. Do not change our materials or suggest we endorse you beyond what we approve.
11. Suspension. We may change or stop any part of the Services, or suspend or end your access, at any time, including if you break these Terms. These Terms keep applying after your access ends.
12. Disclaimers. The Services are provided "as is" and "as available," without warranties of any kind, to the fullest extent allowed by law. No earnings, funding or outcome is guaranteed.
13. Limitation of liability. To the fullest extent allowed by law, Tasskel Capital is not liable for indirect, incidental, special or consequential damages, or lost profits, from your use of the Services. Our total liability will not exceed the greater of $100 or the amount we paid you in the prior 12 months.
14. Indemnity. You agree to defend and hold Tasskel Capital harmless from claims arising from your use of the Services, your marketing, or your breach of these Terms or the law.
15. Governing law and disputes. These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. The state and federal courts located in Madison County, North Carolina have exclusive jurisdiction over any dispute arising from these Terms.
